Sell Property During a Divorce

A house is often the biggest asset in a divorce, and the biggest source of disagreement about what to do next. One person wants to sell now. The other wants to wait. Neither wants to deal with repairs, showings, and strangers walking through the home while everything else is unsettled.

We buy houses directly from couples who are separating and want the property resolved without a drawn-out listing process. We work with both parties and their attorneys, not around them.

Why couples consider a direct sale during divorce

  • A faster sale means the asset gets divided sooner, instead of hanging over the settlement for months.
  • No repairs, cleaning, or staging — especially useful when neither party wants to spend more money or time on a house they’re leaving.
  • No showings through a home two people are actively trying to separate from.
  • A cash offer with a clear number can simplify settlement talks, since both sides are working from one figure instead of a listing estimate.

How it works when there are two owners

We need agreement from everyone on title before any sale can close — that is true of any sale, not just a direct one. If you and your spouse (or your attorneys) are already aligned that the house should sell, we review the property, give you a number, and work on a timeline that fits your situation. If you are not yet aligned, we are glad to put a number in front of both parties so there is something concrete to work from, but we cannot make that decision for you.

What we will not do

We do not get involved in the divorce itself, custody, or how proceeds get divided — that is between you, your spouse, and your attorneys. We are not a law firm and this is not legal advice. For anything about the settlement itself, talk to a California family law attorney.

Questions people ask

Do both spouses need to agree to sell to you?

Yes. Anyone on title needs to agree to the sale, the same as with any buyer. If that agreement does not exist yet, a number from us can be something to work from, but it will not resolve the disagreement itself.

Can our attorneys talk to you directly?

Yes. We are glad to work directly with each side’s attorney once you tell us who to contact.

Does the house need to be in both names still?

Usually, yes, until a settlement or court order changes title. Tell us where things stand and we will tell you what we need to move forward.

What if we are not divorced yet, just separated?

That is fine. Many of the couples we talk with are mid-process, not finalized.
